Appeals court clears way for Clovis Winco

A new Winco grocery store can get built now that a panel of appellate judges upheld the city of Clovis’ zoning for the project.

The 5th District Court of Appeal panel said the city properly followed zoning laws in its 2010 approval of the 94,683-square-foot grocery store at Peach and Herndon avenues. There also is about 21,000-square feet of additional space for other stores.

A lawsuit filed in 2010 said the city didn’t properly zone the grocery store when the City Council voted to place it in a mixed-use zone, which allows for commercial projects.

Fresno County Superior Court Judge Mark Snauffer said last year that the city zoning allows for a supermarket.
